Claims Manager

Summary The Claims Manager is responsible for managing the reportable and self-managed claims and insurance defense litigation of a department composed of two or more claim administrators and other staff.

The claims manager reports to senior legal management, including the General Counsel.

Job Functions Oversees both litigated and non-litigated insurance claims for property and casualty losses (to include some specialty lines) with primary focus being General Liability, Business Auto and Worker’s Compensation.

Ability to guide and direct disputed workers compensation cases and insurance defense litigation from inception to conclusion with an emphasis on managing a diverse litigation docket in multiple jurisdictions, responding to subpoena and discovery requests (including e-discovery), issuing litigation holds, strategizing and reviewing pre-trial motions, recommending insurance and deductible reserves for business unit approval and recommending case resolution to business unit leaders.

Works closely with insurance carrier defense attorneys and adjusters on claims and cases, and may attend settlement conferences, trials, and hearings.

Provides support to the corporate legal department on uninsured and/or coverage disputed matters.

Oversees deductible billing reviews, preparation of monthly reports, and other internal database record-keeping and reporting.

Serves as the company representative in depositions as required.

Manages and/or assist in restitution/subrogation activities.

Required Knowledge Knowledge of various state labor code provisions pertaining to workers’ compensation rules, regulations, and appeals.

Working knowledge of the rules of civil procedure in state and federal courts including the rules on e-discovery Understanding of standard claims handling, evaluation techniques, references, and settlements.

General working knowledge of the insurance defense litigation in the courts.

General working knowledge of worker’s compensation claims, including familiarity with medical and legal terminology related to workers’ compensation claims and personal injury claims processing.

Skills Ability to manage a team of 2 or more, as well as managing the claims and insurance defense litigation.

Can analyze, interpret, and apply laws, rules, and regulations pertaining to workers’ compensation, occupational health and safety, automobile insurance and general liability insurance.

Familiarity and experience with the rules of civil procedure governing civil litigation.

Writes clear, comprehensive, and accurate reports and correspondences.

Works effectively with corporate, operating units, insurance carrier personnel, and the public.

Effectively communicates orally and in writing.

Education, Qualifications, and Experience Bachelor’s degree required, and a licensed adjuster in at least one jurisdiction 10 plus years of related experience required, 5 of which must be managing the claims division of a business, preferably a large construction entity.

Familiar managing claims and insurance defense litigation in one or more of the following states: Arizona, California, Colorado, Hawaii, Idaho, Montana, Nevada, Texas, or Utah.
